Quick answer

Hiring an artist in Brazil requires the contractor to register in advance with the Ministério do Trabalho, a registered contract, and three withholdings: 11% INSS on the fee, capped at 8,475.55 reais, IRRF under the 2026 progressive tax table, and ISS in the municipality where the performance takes place. If the artist is non-resident, IRRF is a flat 25%.

Before you transfer an artist's fee in Brazil, there are three things to sort out that aren't in the artistic contract: the contractor's registration with the Ministério do Trabalho, a registered employment contract, and the withholdings. These are 1978-vintage rules sitting alongside the 2026 IRRF table, and the costliest mistake isn't the fine — it's discovering that the net amount the artist expected wasn't the gross figure you signed up to.

Do you need to register to hire an artist in Brazil?

Yes, and the obligation falls on the contractor, not the artist. Decreto n.º 82.385, de 5 de outubro de 1978 implements the law on artistic professions, and its Article 3 extends the regime "às pessoas físicas ou jurídicas que tiverem a seu serviço os profissionais definidos no artigo anterior, para realização de espetáculos, programas, produções ou mensagens publicitárias" (to individuals or legal entities that employ the professionals defined in the previous article, for the staging of shows, programmes, productions or advertising messages). The sole paragraph leaves no room for doubt: "As Pessoas físicas ou jurídicas de que trata este artigo deverão ser previamente inscritas no Ministério do Trabalho" (Individuals or legal entities covered by this article must register in advance with the Ministério do Trabalho).

Article 4 lists what must be submitted: the company's incorporation document registered with the Junta Comercial, proof of payment of the trade union contribution, and the tax registration number with the Receita Federal. In return, the ministry issues a "cartão de inscrição que lhe faculte instruir pedido de registro de contrato de trabalho de Artista e Técnico em Espetáculos de Diversões" (registration card entitling the holder to file an application to register an Artist or Entertainment Technician's employment contract).

That procedure is still in force, just under a different name. The Registro de Contratante FAQ published by the Ministério do Trabalho e Emprego describes it for "Pessoas físicas ou Jurídicas que tiverem a seu serviço Artista ou Técnico em Espetáculos de Diversões ou Músicos" (individuals or legal entities employing an Artist, Entertainment Technician or Musician), cites Decreto n.º 82.385/1978 and Portaria MTP n.º 671, de 8 de novembro de 2021 as its basis, and clarifies two useful points: "Não há custo financeiro para a obtenção do registro de contratante" (There is no financial cost to obtaining contractor registration) and that it has "validade de 1 (um) ano e em todo território nacional, sendo renovável" (validity of one year, nationwide, and renewable). The application is generated in the SIRPWEB system and filed through gov.br.

One detail worth flagging in the original text: the decree's publication in the Diário Oficial refers to "Lei nº 5.533, de 24 de maio de 1978" when the law actually being implemented is Lei n.º 6.533 of that same date. It's a typo in the original, not a different statute, and it's worth knowing in case anyone challenges the citation.

What professional registration does the artist need?

Their own, and it comes before the work begins. Article 6 of Lei n.º 6.533, de 24 de maio de 1978 states that "o exercício das profissões de Artista e de Técnico em Espetáculos de Diversões requer prévio registro na Delegacia Regional do Trabalho do Ministério do Trabalho, o qual terá validade em todo o território nacional" (practising the professions of Artist or Entertainment Technician requires prior registration with the Regional Labour Office of the Ministério do Trabalho, valid throughout the national territory). The Delegacias Regionais no longer exist under that name, but the registration still does: the ministry now processes it through the Sistema Informatizado de Registro Profissional.

Article 7 opens three routes: a higher education diploma in the subject, a second-level vocational qualification certificate, or an "atestado de capacitação profissional fornecido pelo Sindicato representativo das categorias profissionais" (professional competence certificate issued by the relevant trade union). The Registro Profissional FAQ confirms that artists and entertainment technicians are among the categories that can register with the union certificate, and that its acceptance "está condicionada às exigências impostas pela legislação" (is subject to the requirements imposed by law).

For the organiser this is not someone else's paperwork. If the artist has no registration, the contract that Article 29 of Decreto 82.385/1978 requires to be registered simply cannot be filed: that article requires the professional's Carteira de Trabalho e Previdência Social to be submitted already showing the registration. Asking for the artist's professional registration number when the line-up is confirmed costs one email; sorting it out the week of the event does not.

What does an artist's contract in Brazil require?

Written form, fixed content, and a union endorsement. Article 9 of Lei n.º 6.533/1978 says that practising these professions "exige contrato de trabalho padronizado, nos termos de instruções a serem expedidas pelo Ministério do Trabalho" (requires a standardised employment contract, under instructions to be issued by the Ministério do Trabalho). Those instructions are today Portaria MTP n.º 671, de 8 de novembro de 2021, which approves the standard contract templates for musicians, artists and entertainment technicians.

Article 10 sets twelve mandatory elements: the parties' details, duration, nature of the role, title of the programme or production, performance venues, working hours including breaks, remuneration, credits, weekly rest day, travel, additional duties, and the labour documentation number. The employer applies for the contract's registration: Article 28 of Decreto 82.385/1978 assigns that application to the employer, and Article 29 lists the documents required, starting with "2 (duas) vias do instrumento do contrato de trabalho, visadas pelo Sindicato representativo da categoria profissional e, subsidiariamente, pela Federação respectiva" (two copies of the contract instrument, endorsed by the representative trade union and, failing that, by the relevant Federation).

For a one-off performance there's a shorter route, and it comes with small print. Article 30 of the decree allows a "nota contratual" to be used to replace an artist or for "prestação de serviço caracteristicamente eventual, por prazo não superior a 7 (sete) dias consecutivos, vedada a utilização desse mesmo profissional, nos 60 (sessenta) dias subseqüentes, por essa forma, pelo mesmo empregador" (a service that is by nature occasional, lasting no more than seven consecutive days, with the same professional barred from being engaged in this way by the same employer again within the following sixty days). Translated into booking terms: a venue cannot string together contractual notes with the same DJ every fortnight. The second time round, within those sixty days, this route is no longer available.

Two more rules from Lei 6.533/1978 rarely appear in standard contracts. Article 21 sets normal working hours by sector, with six hours a day in several of them and a session-based regime for theatre, and Article 31 grants these professionals "penhor legal sobre o equipamento e todo o material de propriedade do empregador, utilizado na realização de programa, espetáculo ou produção, pelo valor das obrigações não cumpridas pelo empregador" (a legal lien over the equipment and all materials owned by the employer and used in staging the programme, show or production, up to the value of the employer's unpaid obligations). An unpaid fee can end up as a legal claim over the promoter's backline.

How much INSS is paid on a fee in 2026?

Two separate contributions on the same payment. When the artist performs without an employment relationship, they count as an individual contributing insured party, and Article 4 of Lei n.º 10.666, de 8 de maio de 2003 obliges the company "a arrecadar a contribuição do segurado contribuinte individual a seu serviço, descontando-a da respectiva remuneração, e a recolher o valor arrecadado juntamente com a contribuição a seu cargo" (to collect the contribution of the individual contributing insured party in its service, deducting it from the relevant remuneration, and to pay the amount collected together with its own contribution). Paragraph 2 adds that the legal entity must register its contractors with the INSS as individual contributors if they aren't already.

The 11% that everyone cites isn't written as such in any single law: it's the result of two articles. Lei n.º 9.876, de 26 de novembro de 1999 introduced into Lei n.º 8.212/1991 the employer's contribution of "vinte por cento sobre o total das remunerações pagas ou creditadas a qualquer título, no decorrer do mês, aos segurados contribuintes individuais" (twenty per cent on the total remuneration paid or credited under any heading, during the month, to individual contributing insured parties), and allowed the individual contributor to deduct from their own 20% contribution "quarenta e cinco por cento da contribuição da empresa" (forty-five per cent of the company's contribution), with the deduction "limitada a nove por cento do respectivo salário-de-contribuição" (capped at nine per cent of the relevant contribution salary). Twenty minus nine: eleven.

The cap is set every January by an inter-ministerial portaria. Portaria Interministerial MPS/MF n.º 13, de 9 de janeiro de 2026, published in the Diário Oficial on 12 January 2026, adjusted social security values by 3.90%; the contribution salary range became 1,621.00 to 8,475.55 reais. The cap applies to the insured party, not to the company: the employer's 20% contribution falls on the total amount paid, with no ceiling.

The payment deadline is the 20th. Lei n.º 11.933, de 28 de abril de 2009 gave Article 30, I, b of Lei n.º 8.212/1991 the wording that requires own contributions and those withheld on the remuneration of employees, casual workers and individual contributors to be paid over "até o dia 20 (vinte) do mês subsequente" (by the 20th of the following month).

What happens if the artist invoices through their own company

The picture changes, it doesn't disappear. Article 4 of Lei n.º 10.666/2003 refers to the "segurado contribuinte individual a seu serviço" (individual contributing insured party in its service): if the contract is with a legal entity, there's no 11% withholding or 20% employer contribution on the fee, and the social security charges are settled within the artist's own company. This is a reading of the text, not a published Receita Federal ruling, and it doesn't exempt anything else: ISS is still owed, and the labour obligations of Lei n.º 6.533/1978 still apply to anyone with artists "a seu serviço" (in their service).

How much IRRF is withheld from the fee in 2026?

Under the monthly progressive table, and the payer applies it at source. The Receita Federal publishes for 2026 a table based on Lei n.º 15.191, de 11 de agosto de 2025, with exemption up to 2,428.80 reais a month, four brackets, and a monthly simplified deduction of 607.20 reais.

Monthly calculation base (R$)RateDeduction (R$)
Up to 2,428.80——
From 2,428.81 to 2,826.657.5%182.16

From 3,751.06 to 4,664.6822.5%675.49
Above 4,664.6827.5%908.73

With those two pieces, the full calculation can be done. On a fee of 20,000 reais paid to a Brazilian artist with no employment relationship, our own calculation based on the rules cited above gives this:

ItemAmount (R$)Basis
Gross fee agreed20,000.00Contract
INSS withheld from the artist (11% of the 8,475.55 cap)932.31Lei 9.876/1999 and Portaria MPS/MF 13/2026

Employer's contribution (20%, uncapped)4,000.00Art. 22, III, Lei 8.212/1991
Total cost to the organiser24,000.00Own calculation

Two readings of that table. The artist receives 73.7% of the fee they signed for, and the organiser pays 120% of the agreed amount: the gap between what one party means by "twenty thousand" and what the other means is 9,267 reais. The simplified deduction of 607.20 reais isn't used in this example because the INSS withheld is larger: only whichever reduces the base the most applies, not both. It's worth spelling out in the contract whether the figure is gross or net; it's the same problem described in our guide to hiring artists in Italy with agibilità INPS, just with three taxes instead of one.

Where is ISS paid on the fee, and who withholds it?

In the municipality where the performance takes place, and the payer is usually the one liable. Article 1 of Lei Complementar n.º 116, de 31 de julho de 2003 subjects the services on its attached list to ISS, and item 12 covers entertainment: 12.07 covers "Shows, ballet, danças, desfiles, bailes, óperas, concertos, recitais, festivais e congêneres" (shows, ballet, dance, parades, balls, operas, concerts, recitals, festivals and the like), 12.12 covers "Execução de música" (musical performance), and 12.13 covers "Produção, mediante ou sem encomenda prévia, de eventos, espetáculos, entrevistas, shows (…) e congêneres" (the production, whether or not commissioned in advance, of events, shows, interviews, concerts (…) and the like).

The place-of-taxation rule is in Article 3, XVIII: the tax is owed at the place "da execução dos serviços de diversão, lazer, entretenimento e congêneres, no caso dos serviços descritos nos subitens do item 12, exceto o 12.13" (where entertainment, leisure and similar services referred to in the subitems of item 12 are carried out, except 12.13). A tour across ten cities splits ISS between ten municipalities; only production is taxed at the provider's domicile. The maximum rate is 5%, under Article 8, II, and the minimum is 2%, under Article 8-A, added by Lei Complementar n.º 157, de 29 de dezembro de 2016.

Each municipality decides who pays the tax over. Article 6 of LC 116/2003 allows municipal law to assign liability to a third party connected to the taxable event, and its § 2, I already directly designates as liable the "tomador ou intermediário de serviço proveniente do exterior do País ou cuja prestação se tenha iniciado no exterior do País" (recipient or intermediary of a service originating abroad, or whose provision began abroad). In other words: if you're paying an artist from outside Brazil, the ISS on the fee is your problem under the complementary law itself, with no need to wait for local legislation.

At the same time, the municipality can require you to declare the event before you start selling tickets. The Prefeitura de São Paulo runs the Sistema de Diversões Públicas e Eventos, where the provider declares the data needed to determine ISS and the TFE and requests authorisation to use tickets, with a deadline before the event for non-recurring services and up to the 10th of the following month for recurring ones. That piece and the rest of box-office taxation are covered in our guide on how to sell tickets in Brazil.

What's withheld, and what visa does a foreign artist need?

A flat 25%, with no brackets. Article 7 of Lei n.º 9.779, de 19 de janeiro de 1999 is explicit: "Os rendimentos do trabalho, com ou sem vínculo empregatício, e os da prestação de serviços, pagos, creditados, entregues, empregados ou remetidos a residentes ou domiciliados no exterior, sujeitam-se à incidência do imposto de renda na fonte à alíquota de vinte e cinco por cento" (income from work, whether or not under an employment relationship, and from the provision of services, paid, credited, delivered, used or remitted to residents or persons domiciled abroad, is subject to withholding income tax at a rate of twenty-five per cent). There's no tax-free minimum or progressive table. On a fee of 20,000 reais that's 5,000 in IRRF; if the contract promises a net amount of 20,000, the gross figure needed rises to 26,666.67 — our own calculation based on that article.

On top of that, there's a 1978 obligation still in force that catches almost everyone off guard. Article 25 of Lei n.º 6.533/1978 states: "Para contratação de estrangeiro domiciliado no exterior, exigir-se-á prévio recolhimento de importância equivalente a 10% (dez por cento) do valor total do ajuste à Caixa Econômica Federal em nome da entidade sindical da categoria profissional" (to hire a foreigner domiciled abroad, prior payment of an amount equivalent to 10% of the total value of the agreement must be made to the Caixa Econômica Federal, in the name of the relevant trade union). Ten per cent of the total value of the deal, deposited in advance, in the union's name.

The visa required depends on how the payment is structured. Lei n.º 13.445, de 24 de maio de 2017 prohibits, in § 1 of Article 13, holders of a visitor visa from "exercer atividade remunerada no Brasil" (engaging in paid activity in Brazil), but § 2 expressly permits them to "receber pagamento do governo, de empregador brasileiro ou de entidade privada a título de diária, ajuda de custo, cachê, pró-labore ou outras despesas com a viagem, bem como concorrer a prêmios, inclusive em dinheiro, em competições desportivas ou em concursos artísticos ou culturais" (receive payment from the government, a Brazilian employer or a private entity as a daily allowance, expenses, fee, professional remuneration or other travel costs, as well as compete for prizes, including cash prizes, in sporting competitions or artistic or cultural contests). For a performance under contract, Article 14, I, j provides for a visto temporário for "atividades artísticas ou desportivas com contrato por prazo determinado" (artistic or sporting activities under a fixed-term contract). The same split between one-off payment and contract appears in our guides on foreign artists in the UK and on withholding for foreign artists in the United States.

What we haven't been able to verify

Three points remain open, and we'd rather say so than fill them in.

The first is INSS for the non-resident artist. The rules cited govern individual contributor withholding without distinguishing by residence, and Brazil has social security agreements with several countries that may override the contribution requirement; we haven't found a published act that settles the case of a one-off fee, so that cell is left blank in the table.

The second is whether the Article 14, I, j temporary visa also requires prior work residence authorisation. The list of residence authorisation categories published by the Ministério da Justiça does not include artistic or sporting activity, and the consular page that does describe it was not accessible. The sensible move is to check with the consulate before booking flights.

The third is the updated amount of the penalties. Article 33 of Lei n.º 6.533/1978 sets them at "2 a 20 vezes" (2 to 20 times) a reference value that is no longer published under that name, and there's no official conversion to reais in the text itself.

So what part of this does Futura Tickets cover?

None of the obligations above can be delegated to a ticketing provider: contractor registration, the endorsed contract, withholdings and the visa are the organiser's responsibility, or their Brazilian tax adviser's. What does depend on the sales system is the calculation base: gross box office, complimentary tickets, the split by municipality on a tour, and the exportable history used to justify each settlement afterwards.

Futura Tickets is a Spanish SaaS ticketing platform for professional organisers, selling in 9 languages and across 11 country domains. With Futura Tickets, the attendee database belongs 100% to the organiser: emails and phone numbers are handed over in full, in line with GDPR — something that in Brazil also needs reading alongside buyer data under LGPD. To compare options, there's our review of available ticketing software.

Checklist before signing with an artist in Brazil

Seven checks, all of them before the concert is announced.

Check your contractor registration and its expiry. The ministry grants it for one year, renewable. An expired registration tends to surface when a contract needs filing — in other words, too late.

Ask for the artist's professional registration number. Article 29 of Decreto 82.385/1978 requires the Carteira de Trabalho to already show the registration before the contract can be filed.

Decide between a full contract or a nota contratual, and count the days. The nota contratual covers up to seven consecutive days and blocks the same professional from being engaged this way again for the following sixty days.

Spell out whether the fee is gross or net. Under the 2026 table, a gross amount of 20,000 reais leaves 14,732.81 for a resident artist; a net amount of 20,000 with 25% withholding requires a gross figure of 26,666.67 for a non-resident.

Mark the 20th on the calendar. It's the deadline set by Article 30, I, b of Lei n.º 8.212/1991 for paying over the previous month's withholdings and employer contribution.

Map out ISS by municipality along the tour. Item 12 is taxed where it's performed, at rates between 2% and 5%, and in cities such as São Paulo the event must be declared in advance.

If the artist lives abroad, set aside the 10% union deposit and check the visa. The deposit under Article 25 of Lei n.º 6.533/1978 is due in advance, and a visitor visa won't do if there's a fixed-term contract.

Conclusion

Brazil has no one-stop shop for hiring artists: it has a 1978 labour registration, a 2026 tax table, and a municipal tax that changes creditor in every city on the tour. The good news is that almost all of it is spelled out precisely — the 11%, the 20%, the 25%, the 10% union deposit, the seven days of the nota contratual — and can be budgeted for before signing. The bad news is that the default split penalises whoever doesn't calculate it: the organiser who doesn't distinguish gross from net finds out their real margin on transfer day. If you're also selling tickets, the other end of the chain is covered in the ticket sales rules under Decreto 13.108/2026.

Frequently asked questions

Do you need to register to hire an artist in Brazil?
Yes. The sole paragraph of Article 3 of Decreto n.º 82.385/1978 obliges individuals and legal entities employing artists or entertainment technicians to register in advance with the Ministério do Trabalho. The application is filed through the SIRPWEB system, carries no cost, and according to the ministry is valid for one year across the national territory.
How much INSS is withheld on an artist's fee in 2026?
11% of the remuneration, with the contribution salary capped at 8,475.55 reais from 1 January 2026, plus 20% payable by the contractor on the total amount paid. The withholding from the artist comes from deducting, from the 20% in Article 21, the deduction of up to 9% allowed under Article 30, § 4.
What IRRF is withheld from a foreign artist performing in Brazil?
25%. Article 7 of Lei n.º 9.779/1999 subjects to a flat 25% withholding tax income from work, with or without an employment relationship, and income from services paid, credited or remitted to residents or persons domiciled abroad. There's no progressive table or tax-free minimum.
Which municipality collects the ISS on a concert fee?
The one where the performance takes place. Article 3, XVIII of Lei Complementar n.º 116/2003 places the ISS on entertainment services under item 12 in the municipality where they're performed, except subitem 12.13, event production, which is taxed at the provider's domicile. The rate ranges from 2% to 5%.
What visa does a foreign artist need to perform in Brazil?
It depends on the contract. Lei n.º 13.445/2017 bars holders of a visitor visa from carrying out paid activity, but allows them to receive a fee, expenses or prizes from a Brazilian employer. For artistic activities under a fixed-term contract, Article 14, I, j provides for the temporary visa.
Can an organiser hire the artist through their company?
In practice this is common with artists who have their own corporate structure, and in that case there's no 11% INSS withholding, because Article 4 of Lei n.º 10.666/2003 refers to the individual contributing insured party in the service of a company. ISS and the labour obligations under Lei n.º 6.533/1978 still apply.
